The New York State Attorney General’s office extended a deadline to Nov. 6th for individuals seeking compensation from two fraudulent immigration organizations.
In July, the New York State Office of the Attorney General announced the creation of a $2.2 million fund to compensate the clients of two non-profits that allegedly defrauded immigrants and engaged in the unauthorized practice of law.
Anyone who received services from the International Immigrants Foundation, Inc. (IIF) and the International Professional Association, Inc. (IPA) is eligible for funds and should file for restitution with the New York Legal Assistance Group (NYLAG).
“Thousands of immigrants who had their trust abused and their money stolen by these organizations deserve to receive compensation, and now they can,” Attorney General Eric Schneiderman said in a press release.
Yisroel Schulman, NYLAG’s President, added, “Every immigrant who was defrauded and put at risk should be given the opportunity to share in this fund, which was created on their behalf.”
The deadline has been extended due to the continuing high volume of interest.
According to NYLAG immigration attorney Indiana Porta, about 2,000 people have already responded to calls for compensation. She estimates that roughly 5,000 are entitled to compensation.
“NYLAG reviewed thousands of cases when we took over as receivers when IFF/IPA closed. But their office and their records were in shambles, so it is really hard to be precise about who is entitled,” she said.
Both IPA and IFF were sued by the State Attorney General’s office in 2010 after it was revealed that representatives from both firms falsely claimed to be lawyers and gave their clients incorrect advice. The founder and president of IIF and IPA, Edward Juárez, was not a lawyer, but claimed to be one.
In a 2013 settlement with the State, Juárez’s businesses were closed and he was prohibited from engaging any form of legal services or acting as a fiduciary for any not-for-profit corporation or charity in New York State. Proceeds from the businesses were set aside for a $2.2 million restitution fund.
According to Porta, people who’ve been deported as a result of dealings with the two firms are also eligible for funds, though she noted, “The chances of returning to the U.S. would be extremely low.”
“We have also received claims and calls from people who were not deported, but have chosen to move abroad—typically to their country of origin—since receiving legal services from IIF/IPA,” she added.
Carlos Menchaca, the New York City Councilmember who chairs the city’s Committee on Immigration applauded the extension by the AG’s office. “The extended deadline gives us the unique opportunity to reach out to a large universe of affected individuals and families,” he said. “[It] helps us ensure that justice is served more broadly.”

Yisrael Schulman, presidente de NYLAG, añadió: “Cada inmigrante que fue defraudado y puesto en riesgo, debe tener la oportunidad de participar de este fondo, que fue creado en su nombre”.
El plazo se ha ampliado debido al creciente interés.
Según la abogada de inmigración de NYLAG Indiana Porta, cerca de 2,000 personas ya han respondido a las peticiones de indemnización. Ella estima que aproximadamente 5,000 tienen derecho a una indemnización.
“NYLAG revisó miles de casos cuando nos hicimos cargo como receptores cuando IFF/IPA cerró. Sin embargo, su oficina y sus registros se encontraban en ruinas, por lo que es muy difícil precisar quién tiene derecho”, comentó.
Tanto IPA e IFF fueron demandadas por la oficina del fiscal general del estado en el año 2010 después de que se reveló que los representantes de ambas empresas declararon falsamente ser abogados y dieron a sus clientes un asesoramiento incorrecto. El fundador y presidente de IIF e IPA, Eduardo Juárez, no era abogado, pero afirmó ser uno.
En un acuerdo con el estado de 2013, las empresas de Juárez fueron cerradas y se les prohibió participar en cualquier tipo de servicio legal y a actuar como fiduciario para cualquier corporación sin fines de lucro o caridad en el estado de Nueva York. Las ganancias de las empresas se reservaron para un fondo de restitución de 2.2 millones de dólares.
Según Porta, las personas que han sido deportadas como resultado de negociaciones con las dos empresas también son elegibles para los fondos, aunque señaló: “Las posibilidades de regresar a los Estados Unidos son mínimas”.
“También hemos recibido reclamos y llamadas de personas que no fueron deportadas pero que optaron por mudarse al extranjero, por lo general a su país de origen, porque recibieron servicios legales de IIF/IPA”, agregó.
Carlos Menchaca, el concejal de la ciudad de Nueva York que preside el comité de la ciudad sobre inmigración, aplaudió la prórroga la oficina del fiscal general. “La fecha límite extendida nos da la oportunidad única de tartar de contactar a un gran universo de personas y familias afectadas”, dijo. “Nos ayuda a asegurar que se haga justicia de manera más amplia”.
