The Progressive Caucus of the New York City Council is urging the de Blasio administration to take action against the remaining officers involved in the 2012 shooting of Bronx teenager Ramarley Graham. “We request immediate action from your administration to hold the remaining officers responsible for Ramarley Graham’s killing and its related misconduct accountable in a transparent manner,” the Caucus said last week in a letter sent to Mayor Bill de Blasio and New York Police Commissioner James O’Neill. “NYPD trial dates should be scheduled for the two other officers charged (Sergeant Scott Morris and Officer John McLoughlin), who were charged by the department in the same year (2012) that Graham was killed,” the letter said. “We urge you to publicly release the departmental charges that these officers face, along with start dates for their trials, without any further wavering.” In its letter, the Caucus also expressed disappointment in the handling of the disciplinary process related to Graham’s killing, including the department’s allowing Richard Haste to resign rather than be terminated. “It is disgraceful that after more than five years since killing Ramarley and subsequently accruing pay raises and overtime, Richard Haste was not immediately suspended when Deputy Commissioner Maldonado’s draft report was provided to the department,” the letter read. “The NYPD’s failure to take swift action against Haste allowed him to resign. It was a failure of accountability and must not be repeated for the several other officers involved in Graham’s killing.” The letter also urged the NYPD to comply with the Freedom of Information Law (FOIL) request by Graham’s family, which sued the NYPD for failure to release documents. On June 22, the family of Graham and their community supporters released documents previously withheld by the NYPD under the state law 50-a. The documents released include the final report and recommendation from the trial of Richard Haste by NYPD Deputy Commissioner of Trials and the final report of the Firearm Discharge Review Board (FDRB) into Haste’s firing of his weapon. The report from the departmental trial makes several criticisms of Sergeant Morris for giving “no direction to the officers.” The report also indicates that McLoughlin kicked in the door to the apartment and that both he and Haste entered without direction from their supervisor. The FDRB report indicates that Sergeant Morris “exercised poor tactical judgment,” “failed to supervise his subordinates,” and “violated SNEU procedural and training guidelines” and that Officer McLoughlin “exercised poor tactical judgment.” “These documents only add to the evidence that both Sergeant Scott Morris and Officer John McLoughlin must be fired for the killing of my son Ramarley. They are a danger to public safety and should not continue to collect paychecks from the NYPD,” said Graham’s mother, Constance Malcolm. Malcolm asserted that NYPD Deputy Commissioner Kevin Richardson told her during Haste’s trial that Morris and McLoughlin would face trials after Haste, but noted that no trials have yet been scheduled. “I’m worried that Mayor de Blasio and the NYPD are not taking accountability for killing Ramarley seriously, and that Morris and McLoughlin will get slaps on the wrists instead of being fired, as they deserve,” Malcolm said. “It’s a slap in the face to my family and community and another indication of their lack of commitment to black lives taken by police in New York City.” “This moment in time, with knowing all for which we have learned in regards to the truth as to Ramarley’s death, the Mayor and the NYPD have an opportunity to restore trust in the people they serve by terminating Morris and McLoughlin,” said Royce Russell, an attorney for the family. “This is the moment to re-establish the old standards of accountability.”
